Enrollment of Non-Resident Students (JBCC)

1. Kansas Law now requires all public-school districts to accept non-resident students.

2. The Superintendent or designee has the responsibility for studying capacity in each school of the district, and at each grade level.

   1. Kindergarten through grade 8 at each building.

   2. Each building or program at High School.

3. On or before May 1 of each year, the superintendent shall present the recommendations concerning capacity to the board for adoption or modifications.

   1. Capacity based on the study conducted by the superintendent.

   2. The number of students expected to attend school in the district.

   3. The number of open seats available to nonresidents at each grade, building, or program level.

      1. When determining capacity, the district will total all resident and currently enrolled nonresident students at each grade level before determining open seats available.

4. On or before June 1 of each year, the district shall publish the number of open seats available to non-resident students in each grade level for each school building of the district for the next succeeding school year on the school district's website.

5. From June 1 through June 30, district administration shall accept applications from non-resident students.

   1. If the number of applications are less than the number of available seats, the non-resident students shall be accepted.

   2. If the number of applications for a grade level in a school building is greater than the number of available seats, district administration shall randomly select non-resident students using a confidential lottery process. This process shall be completed by July 15 of each year.

Priority in Filling Open Seats

• Any sibling of a non-resident student who was accepted to enroll in and attend school in the district.

• Any non-resident student who is a military student

Regardless of Capacity, the Following Students Shall be Allowed to Enroll

• Any child who is in the custody of the Department for Children and Families.

• Any child who is experiencing homelessness.

• Any non-resident student who has a parent or person acting as a parent employed by the district.

Transportation

• Transportation of non-resident students to school is not required

Non-Resident Student Continued Enrollment

• A non-resident student who has been accepted for enrollment and attendance at the school district shall continue until graduation.

• The district will not require parents to resubmit a new application each school year.

• Non-resident students may be denied enrollment for not being in good standing with the district.

Not in Good Standing

• The non-resident student failed to maintain a 90% attendance rate in the last school year, excluding excused absences.

• The non-resident student or the student's parent provided false or fraudulent information in the application process.

• The non-resident student is not a resident of Kansas.

• The student is currently under a period of suspension or expulsion from any Kansas school district, and such suspension or expulsion will not

  expire until after the next school year has begun.

• The student has had two or more out-of-school suspensions in the current school year, with discretion being given to the building

  administration.

• The student has been given a long-term suspension or expulsion by the district in the current school year.
